1. Acceptance of Terms

By accessing and using Gigged ("Platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.

2. Platform Role

Gigged is an online marketplace that connects musicians, vendors, and event hosts.

We act solely as a facilitator of bookings and payments and are not a party to any agreement, contract, or transaction between users.

All services are provided by independent third parties, and Gigged does not employ, control, or guarantee the performance of any user.

3. User Accounts

  • You must be at least 18 years old
  • You are responsible for all activity under your account
  • You must provide accurate and up-to-date information
  • We may suspend or terminate accounts at our discretion

4. Bookings and Contracts

  • All bookings form a direct agreement between users
  • Gigged is not responsible for fulfilment, cancellations, or disputes
  • Users are responsible for agreeing on scope, timing, and expectations

5. Payments and Fees

  • Payments will be processed via third-party providers (Stripe)
  • Gigged may charge service fees or commissions
  • By using the Platform, you authorise us to deduct applicable fees

No Liability for Payment Issues: Gigged is not liable for failed payments, delays, chargebacks, or financial losses arising from payment processing.

6. Refunds, Cancellations, and Disputes

  • Cancellation and refund policies are determined by users unless otherwise stated
  • Gigged has no obligation to mediate disputes
  • We may, at our discretion, assist in resolving disputes but are not responsible for outcomes

7. User Conduct

You agree not to:

  • Use the Platform for illegal or fraudulent purposes
  • Misrepresent services or identity
  • Circumvent the Platform to avoid fees
  • Harass, abuse, or harm other users

8. Insurance and Licensing

  • Service providers are solely responsible for obtaining any required licences, permits, and insurance
  • Gigged does not verify or guarantee compliance

9. Content

  • You retain ownership of your content
  • You grant Gigged a worldwide, royalty-free license to use, display, and promote content
  • We may remove content at our discretion

10. Limitation of Liability

To the maximum extent permitted by law, Gigged shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of income, profits, or business opportunities
  • Personal injury, property damage, or event failure
  • Actions or omissions of users

Total liability is limited to the amount paid to Gigged in the preceding 3 months.

11. Indemnity

You agree to indemnify and hold Gigged harmless from any claims, damages, losses, or legal fees arising from:

  • Your use of the Platform
  • Your services or conduct
  • Any breach of these Terms

12. Platform Availability

We do not guarantee uninterrupted or error-free operation of the Platform. We may modify, suspend, or discontinue services at any time.

13. Termination

We may suspend or terminate access at any time without notice if users breach these Terms or pose risk to the Platform.

14. Governing Law

These Terms are governed by the laws of New Zealand.

15. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
